Terms of Service

1. General Provisions

1.1 Purpose

These Terms of Service ("Terms") govern the rights, obligations, and responsibilities between Techtainment ("Operator," "we," "us," or "our") and users ("you" or "User") regarding the use of the mobile application "Zodi" ("Service" or "App").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1.2 Definitions

1. "Service": The AI-powered tarot reading and fortune-telling content service provided through the Zodi mobile application.
2. "User": Any person who uses the Service in accordance with these Terms.
3. "Member": A User who has registered an account through social login and can continuously access the Service.
4. "AI Interpretation": Fortune-telling interpretation content automatically generated using artificial intelligence technology (Google Gemini or Anthropic Claude).
5. "Paid Service": Premium services that require payment, including detailed AI interpretations and subscription plans.
6. "Content": All information provided within the Service, including tarot card images, interpretation texts, fortune information, and user interface elements.
7. "Subscription": A recurring payment plan that grants access to premium features for a defined period.

1.3 Posting and Amendment of Terms

1. We shall make these Terms available within the App so that Users may easily access them.
2. We may amend these Terms to the extent permitted by applicable law.
3. When amending the Terms, we shall notify Users of the effective date and reasons for the amendment at least 7 days in advance within the App. For amendments unfavorable to Users, notification shall be made at least 30 days in advance via email or push notification.
4. If a User does not express objection by the effective date of the amended Terms, the User shall be deemed to have agreed to the amendments. Users who do not agree may discontinue use and delete their account.
5. In the event of any conflict between the English and Korean versions of these Terms, the Korean version shall prevail for Users residing in the Republic of Korea, and the English version shall prevail for all other Users.

2. Account Registration

2.1 Registration Process

1. To use the Service, you must create an account through one of the following social login methods:
   • Google OAuth (via Supabase Auth)
   • Apple Sign-in (via Supabase Auth)
2. During registration, you are required to provide: nickname, date of birth, and gender.
3. You may optionally provide birth time and birth place.
4. You must provide accurate and current information. Providing false or misleading information may result in account termination.

2.2 Age Restrictions

1. Users under 14 years of age are not permitted to create an account or use the Service. By creating an account, you represent and warrant that you are at least 14 years of age.
2. Users under 18 years of age (or the age of majority in their jurisdiction) require consent from a parent or legal guardian to use Paid Services. Paid Service contracts made without such consent may be canceled by the minor or their legal guardian.
3. We may request proof of age or guardian consent at any time and may terminate accounts that do not meet the age requirements.

2.3 Account Responsibilities

1. You are responsible for maintaining the security of your account and all activities that occur under your account.
2. You may not transfer, sell, or lease your account to any third party.
3. You must immediately notify us at support@techtainment.io if you become aware of any unauthorized use of your account or any security breach.
4. We are not liable for any loss or damage arising from your failure to comply with this section.

3. Service Description

3.1 Services Provided

3.2 Free Usage Limits

1. Free Users receive a limited number of tarot readings. Once the free limit is reached, a subscription or one-time purchase is required to continue using the Service.
2. The specific number of free readings and applicable limits are displayed within the App and may be changed at our discretion with reasonable notice.

3.3 Service Availability

1. The Service is provided 24 hours a day, 7 days a week, in principle.
2. We may temporarily suspend or restrict the Service for system maintenance, technical failures, force majeure events (natural disasters, wars, pandemics, government actions), or carrier and third-party service provider outages.
3. We will provide advance notice of planned service suspensions when feasible.
4. If we permanently discontinue the Service, we will provide at least 30 days advance notice.

3.4 Service Modifications

We reserve the right to modify, update, or discontinue any feature of the Service at any time. We will provide reasonable notice for material changes that significantly affect User experience.

4. AI-Generated Content Disclosure

4.1 AI Technology Used

This Service utilizes artificial intelligence (AI) to generate fortune interpretations. All tarot readings and fortune interpretations provided by the Service are automatically generated by generative AI technology:

4.2 AI Content Labeling

In accordance with the Korean Framework Act on Artificial Intelligence (Article 31) and international best practices:

1. All AI-generated interpretations are clearly labeled with indicators such as "AI-Generated Content" or "Powered by AI."
2. The Service discloses the use of AI technology upon account registration and within the App.

4.3 AI Content Limitations

1. AI-generated content may contain inaccuracies, generalizations, or inconsistencies.
2. Results may vary for the same input due to the probabilistic nature of AI models.
3. AI interpretations do not reflect the views or opinions of the Operator.
4. The AI providers (Google and Anthropic) process User data solely for generating interpretations and do not retain User data after processing is complete. User data is not used for AI model training.

The Service does NOT provide and should NOT be relied upon as:

5.3 No Guarantee of Accuracy

1. We do not guarantee the accuracy, reliability, completeness, or timeliness of any fortune interpretation.
2. Fortune-telling, tarot, and astrology are not scientifically proven prediction methods.
3. There is no causal relationship between AI-generated fortune interpretations and actual future events.

5.4 User Responsibility

1. You are solely responsible for any decisions you make based on the Service's content.
2. You should consult qualified professionals before making important decisions regarding health, finances, legal matters, or mental well-being.
3. We strongly discourage excessive reliance on fortune-telling services for daily decision-making. If you experience anxiety or compulsive behavior related to fortune-telling, please seek professional help.

6. Paid Services and Subscriptions

6.1 Paid Service Options

Prices may vary by region and are displayed in the applicable currency within the App. All prices include applicable taxes unless otherwise stated.

6.2 Payment Processing

1. All payments are processed through in-app purchases via the Apple App Store or Google Play Store.
2. Subscription management and entitlements are handled through RevenueCat.
3. By making a purchase, you agree to the payment terms of the applicable app store (Apple or Google).

6.3 Subscription Auto-Renewal

1. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
2. Your app store account will be charged for renewal within 24 hours prior to the end of the current period.
3. You can manage and cancel your subscription at any time through:
   • iOS: Settings > Apple ID > Subscriptions
   • Android: Google Play Store > Subscriptions
4. Canceling a subscription stops future charges but does not provide a refund for the current billing period. You will retain access to premium features until the end of the current paid period.

6.4 Free Trial

1. If a free trial is offered, it will be clearly stated within the App along with its duration and the subscription price that will apply after the trial ends.
2. If you do not cancel before the free trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

6.5 Refunds

1. Subscription refunds are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies:

2. One-time purchase refunds:
   • If you have not viewed the purchased content, you may request a refund within 7 days of purchase.
   • Once digital content has been viewed or accessed, refunds are generally not available, as the digital content has been delivered and consumed in accordance with applicable consumer protection laws.
3. Refunds are available in the following exceptional circumstances regardless of content access:
   • Technical errors preventing content delivery
   • Duplicate charges for the same content
   • Purchases made by minors without parental consent (within 3 months of purchase)
4. To request a refund, contact us at support@techtainment.io or use the applicable app store's refund process.

6.6 Price Changes

We reserve the right to change our pricing. For existing subscribers, price changes will take effect at the beginning of the next billing cycle after notice has been provided. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

7. User Obligations

7.1 Prohibited Conduct

Users shall not engage in the following activities:

1. Providing false information during registration or profile updates.
2. Using another person's identity or account without authorization.
3. Modifying, reverse-engineering, decompiling, or disassembling the App.
4. Attempting to access the Service's servers, databases, or networks without authorization.
5. Reproducing, distributing, or commercially exploiting the Service's content without prior written consent.
6. Transmitting viruses, malware, or any harmful code through the Service.
7. Interfering with or disrupting the Service's infrastructure or other Users' use of the Service.
8. Using the Service for any illegal purpose or in violation of applicable laws.
9. Using automated systems (bots, scrapers) to access or interact with the Service.
10. Circumventing or attempting to circumvent usage limits, payment requirements, or security measures.

7.2 Consequences of Violations

If you violate these Terms, we may issue a warning, temporarily suspend your access to the Service, permanently terminate your account, or pursue legal remedies as permitted by applicable law.

8. Intellectual Property

8.1 Operator's Intellectual Property

1. All content within the Service, including but not limited to tarot card images, tarot card designs, AI-generated interpretation templates, UI/UX design, logos, trademarks, and software code, is owned by or licensed to the Operator and is protected by applicable intellectual property laws.
2. You may not copy, modify, distribute, sell, or create derivative works based on the Service's content without prior written consent.

8.2 User Content

1. You retain ownership of any content you create or submit within the Service (e.g., feedback, reviews).
2. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content for the purpose of operating and improving the Service.

8.3 AI-Generated Interpretations

1. AI-generated tarot interpretations created for your account are provided for your personal, non-commercial use only.
2. You may share your own reading results for personal purposes but may not commercially redistribute them.

9. Limitation of Liability

9.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
2. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
3. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9.2 Limitation of Damages

1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
2. Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.
3. These limitations apply regardless of the legal theory upon which the claim is based.

9.3 Fortune Interpretation Disclaimer

We are not liable for any decisions, actions, or consequences resulting from your reliance on AI-generated fortune interpretations. Fortune readings are entertainment content only, and you use them at your own risk. This limitation does not apply in cases of our willful misconduct or gross negligence.

10. Termination

10.1 Termination by User

1. You may delete your account at any time through Settings > Account > Delete Account within the App, or by contacting us at support@techtainment.io.
2. Upon requesting account deletion, a 30-day grace period applies. During this period, your account is deactivated and data is retained. You may reactivate your account by logging in during the grace period. After 30 days, your account and all associated personal data will be permanently deleted and cannot be recovered.
3. If you have an active subscription, deleting your account does not automatically cancel your subscription. You must cancel your subscription through your app store separately.

10.2 Termination by Operator

1. We may suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activities, fail to comply with applicable laws, or if your continued use poses a risk to the Service or other Users.
2. We will provide notice of termination via email when feasible, along with the reason for termination.
3. You may appeal a termination decision by contacting support@techtainment.io within 30 days.

10.3 Effects of Termination

1. Upon termination, your right to use the Service immediately ceases.
2. Data retention after termination is governed by our Privacy Policy and applicable law.
3. Provisions that by their nature should survive termination (including Sections 5, 8, 9, and 11) shall survive.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles.

11.2 Dispute Resolution

1. In the event of a dispute arising from or relating to these Terms or the Service, the parties shall first attempt to resolve the dispute through good-faith negotiation.
2. If negotiation fails, disputes shall be submitted to the competent court under the Civil Procedure Act of the Republic of Korea.
3. For Users residing in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. You may also bring proceedings in the courts of your country of residence.
4. Users may also seek resolution through:

   • Electronic Commerce Dispute Resolution Committee
   • EU Online Dispute Resolution (for EU Users): ec.europa.eu/odr

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and the Operator regarding the Service.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

1. We may send notices to you via email, in-app notifications, or push notifications.

These Terms of Service are effective from March 21, 2026.
